Federal Title VI Policy
Section 601 of Title VI of the Civil Rights Act of 1964 provides:
“No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance.”
The Civil Rights Restoration Act of 1987 clarified the broad, institution-wide application of Title VI by defining “program or activity” to include all of the operations of covered entities receiving federal financial assistance.
U.S. Department of Justice (DOJ) regulations implementing Title VI are contained in 28 CFR Part 42. U.S. Department of Transportation (USDOT) regulations implementing Title VI are contained in 49 CFR Part 21.
Metro COG adopted its first Title VI/Nondiscrimination Program in 2012 and periodically updates the program in accordance with applicable federal and state requirements.
Metro COG Title VI/Nondiscrimination and ADA Policy Statement
Metro COG is committed to administering its programs, services, and activities in accordance with applicable federal and state nondiscrimination requirements. No person shall, on the basis of race, color, national origin, sex, age, disability, or other status protected by applicable law, be unlawfully excluded from participation in, denied the benefits of, or otherwise subjected to discrimination under any program, service, or activity administered by Metro COG.
In addition to Title VI of the Civil Rights Act of 1964, federal nondiscrimination requirements applicable to Metro COG's federally assisted transportation programs include, as applicable:
- Section 162(a) of the Federal-Aid Highway Act of 1973, 23 U.S.C. § 324 (sex);
- Age Discrimination Act of 1975, 42 U.S.C. § 6101 et seq. (age);
- Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794 (disability); and
- Americans with Disabilities Act of 1990, as amended (disability).

Metro COG also evaluates language-assistance needs for persons with limited English proficiency (LEP) and provides appropriate language assistance consistent with applicable federal requirements and Metro COG's Limited English Proficiency Plan.
Metro COG is committed to implementing its Title VI/Nondiscrimination and ADA Program and maintaining appropriate procedures to prevent and address prohibited discrimination.
The Metro COG Executive Director serves as the agency's Title VI Coordinator and ADA Coordinator and is responsible for administering and monitoring Metro COG's Title VI/Nondiscrimination and ADA Program.
Any person who believes they have been subjected to discrimination in a Metro COG program, service, or activity may contact Metro COG's Title VI Coordinator and ADA Coordinator for information regarding the complaint process.

Nondiscrimination and Title VI Assurances
Metro COG is committed to ensuring that no person or group of persons, on the basis of race, color, national origin, sex, age, disability, or other status protected by applicable law, is excluded from participation in, denied the benefits of, or otherwise subjected to unlawful discrimination under any program, service, or activity administered by Metro COG.
Metro COG will administer its programs, policies, and activities in accordance with applicable federal and state nondiscrimination requirements and will take appropriate steps to prevent and address prohibited discrimination.
Metro COG will also evaluate language-assistance needs for persons with limited English proficiency (LEP) and provide appropriate language assistance, including interpretation and translation services, at no cost when warranted, consistent with applicable federal requirements and Metro COG's Limited English Proficiency Plan.
Metro COG will provide reasonable language assistance, including interpretation and translation services, at no cost to individuals with limited English proficiency (LEP). To help ensure services can be arranged, requests should be submitted to the Metro COG Office Manager at 701-532-5100 at least five business days before a meeting when possible. Metro COG will make reasonable efforts to accommodate requests received with less notice.
